Unfortunately you cannot always rely on people to do what they say they will do.

 

Possible she had every intention to do so...but it got put to the side while she dealt with other people coming in, and then forgotten about.  It's not like she'd be able to leave her desk as soon as you left and run through the office to find the IO dealing with your case right away.

 

Let's say you did have video tape evidence...that video would only show you standing at the front desk, and still wouldn't prove that you submitted the required evidence to the officer.  People visit the office for a vast number of reasons.  Again----without any actual proof retained that you delivered those documents (and nothing you've mentioned sounds like you have any proof, sounds like you did a walk-in instead of making an infopass appointment), there's no room for an appeal.  Curious why you waited until the last possible day to submit them, though?

 

Fortunately, you have the option of applying again.

Hi everyone,

 

I got the same reason for case denial. Could anyone give me some suggestions?

I sent the supporting documents required after the interview on 4/2/2018. I FedEx it and the delivery proof shows that USCIS received it on 4/4/2018 with a signature. So I have the proof the delivery. Denial letter suggests that I could file appeal. BUT I hate to do that because why I have to pay $700 for their mistake? So here are the solutions I have tried so far:

1. Called USCIS customer service 4 times: they were totally not helpful

2. E-Reuqest: the respond letter suggests me to got to InfoPass to show them the proof of delivery.----but lead to #3 below

3. InfoPass: I tried to make reservation. but gosh..it's so freaking difficult to make reservation for New York City branch...I've been trying 1 whole week but never a spot is available...

4. Contacted district Congressman: so far no response yet. It might take up to 60 days for them to respond...

 

 

Please help... Thank you!

You have a few options.

 

The first is to go to infopass (search vj- theres certain times that are better to check or programs that can autocheck). Your case is at the local office. You can go there with the proof of delivery and the appeal form filled out with a check ready. Often they will either just take the proof of delivery and tell you it will be reopened or take the proof and the appeal form with no payment.

 

If they are not helpful and want the form and the payment then its easiest to just give it to them. This will get your case reopened. Then you file another form asking for your money back--wait a long time and get your money back since it was their error.

 

If you dont have the money you can try sending the appeal with no payment and a letter stating its their fault so you arent paying. They may or may not accept it.
