So I'm pretty pissed right now. 

 

My fiance calls me up this morning and tells me that she got a call from the consulate in Kyiv saying that her interview for tomorrow morning has been cancelled because the USCIS requested her petition back again due to a problem (of course there was no explanation). 

 

So to make a long story short, I never received a hard copy of the NOA2 even though I had already received my approval letter from the NVC so at the advice of members on this board I called up the USCIS to make sure they send me an NOA2 hardcopy. In the back of my mind I was also thinking I hope in doing so it doesn't somehow create an issue with our process even though the mistake was on their end. Lo and behold, by coincidence, this happens. I checked my case status at the old USCIS site and there some updates and coincidentally the dates of the updates are the exact same date that I made the call for the NOA2.....the description states that it is for an inquiry I made about not receiving my approval notice. 

 

Now we're probably stuck in some stupid loop because the lady from the consulate that called my fiance told her to check the USCIS website for the update as it still shows received. They never updated the system and I never received my NOA2! The Tier 2 officer when I called the USCIS said it was a mistake on their part and instructed me to not worry and to just proceed as I already have a case number from the NVC.

 

So basically by requesting for an NOA2 hardcopy I essentially screwed myself over as it appears to have created confusion on their part. 

 

I knew I should've left it alone. You don't even need the NOA2 hard copy....I did tons of research and calls after the fact and when you apply for the AOS they already have your alien number and visa information tied to your passport, which, proves that you are approved! Sigh. 

 

What's done is done so now my question is, should I be calling the NVC or the USCIS now to figure out what's going on? I was under the impression that once the NVC has the approval and assigned a case it is handled with them moving forward and doesn't go back to the USCIS. 

 

Even the CEAC website under the status update link our case shows "Ready" and it was updated today Jul 2.

This process is so ridiculous.

there is always somekinda hiccups with this process. If your process is going forward, be happy. After biometrics is another long @$$ wait for EAD/AP

 

Ready means that your paperwork is at the embassy level.  

 

I don't know where they said the NOA-2 is not needed. I handed it over to the CO and you'll need it for AOS paperwork

That's the problem, it was moving forward and now it just took a huge step back. 

 

Even though it says "ready" the embassy is saying they sent it back to USCIS for reasons unknown.  

 

So now I am at the mercy of either the NVC or USCIS, whom, both take forever to respond to any sort of inquiries. 

 

My brother is a good example of not needing the hard copy. He went through the same process with his Japanese wife and he got through it fine without the hard copy. 

 

It doesn't actually say anywhere on the form that you don't need one, I'm simply going by experiences of others (including my brother's) and the simple logic that if you have an alien number/visa number tied to your passport then it's pretty obvious you're approved.

Sorry to hear this, but our experience was different and we did make use of NOA-2 in Kiev. We where worried about the whole process and I attended the interview also. You have no other choice than waiting and/or calling USCIS and see where the documentation went. It could take anytime since there is no definite answer to this. Keep us updated here please. I highly doubt because you made a phone call and this was the cause of a further delay. Nobody except USCIS case agent know why in the world they would suddenly send it back. Wish you good luck and be patient. Every case is different in immigration. No, 2 are the same.

Thanks, I'm on the phone with the NVC now and as usual it's the typical run around with transfers and lots of holding.

Any luck going forward? Have a little down time since my wife is at a ESL class here in a local community center

So I basically got totally screwed over by the USCIS. 

 

NVC had no clue and after spending 3 hours on hold with maybe 15 minutes of talk time with the USCIS a tier 2 officer basically told me that because I called to inquire about not having received an NOA2 hard copy they requested the petition to be returned to to California for review. So I pressed a little without being o aggressive and got the guy to pretty much confirm that had I not called about it in the first place, I would have been fine. 

 

So now he tells me it's under review and I'll get notification once complete on whether or not I got denied, approved, or an RFE. My response was why as I was already approved and he said that doesn't matter because the person looking at it now is different than the one whom originally looked at it. 

 

Aside from that he wouldn't give me any more detail other than to check back in 30 days. 

 

What's done is done so all I can do is hope and pray they don't take another 7 months to process as if I just submitted. 

 

It completely messed up a whole load of plans we had.....

 

Good to hear you all are doing well and your wife is adjusting to the new life.

 

I'll keep you posted but I have a feeling it's going to take awhile.

I am really sorry guys. You did drew the short stick on this one. I hope you guys resolve this matter soon and you can have your fiance soon over. I have heard from delays and they have usually horror stories to tell. Stay positive :thumbs:
