Hello please, my brother inlaw’s sister got married here is the United States. She’s a citizen, husband isn’t but resides here in US, and filed for divorce in Ghana, doesn’t live in Ghana, but filed divorce there. In US, he says they still married but she’s super confused at what to do. Should she file for divorce here or is the Ghana decree final?

Listen old-man and shomyer... there’s no reason to be rude... I saw a forum with similar situation and asked a simple question if you have no answer leave to those that do and stop being disrespectful please. This is a serious situation we dealing with.

Please to those who may have better things to say... please, my brother inlaw’s sister got married here is the United States. Although she’s a citizen and  husband isn’t, they’ve been married for a while now and both resides here in US. The husband filed for divorce in Ghana, even though he doesn’t live in Ghana but he is from Ghana. He claims they still married in US but she’s super confused at what to do. Should she file for divorce here or is the Ghana decree final? Please help... Thanks.

Whatever stress you are under, you don't need to be rude to people who are trying to understand your situation and provide you with help.  I had to read your posts four times before I could understand what was going on.

Is your SIL want to be divorced?  

 

If she is okay with the terms of the Ghana divorce decree, then accept it.  Did she sign anything?

 

If she is not okay with the terms of the Ghana divorce decree, then she can file for divorce in the US and have the Ghanian divorce set aside.

 

She needs to consider the pros and cons of both paths.

 

The husband is wrong.  They can not be married in the US and divorced in Ghana.  It's either married or divorced.

Shes not ok with the decree and I’m not sure if she wants the divorce but says if he could file in Africa then he really wants out. But what’s she’s not sure of is why he filed in Africa and not here in the States where they reside.

He got the divorce in Africa so he can control the divorce and the terms under Ghana rules.  Rules that probably aren't fair to women or non-citizens.  Alternatively, I can see him divorcing in Ghana so he can marry someone there and claim to be married to your SIL in the US and this other woman in Ghana.  Who knows why and the reason doesn't matter if your SIL wants to file for divorce in the US.

 

She can file for divorce in the US and have the US court rule the Ghanian divorce as invalid since he did not file in his home state as required.  If he has a green card, his home state is a state in the US.

everyone here is dealing with the serious situation. No one here is playing golf. Everyone here is under stress and everyone tries to assist each other. your statement was not clear at all therefore i asked for details.

I agree with JOJO

 

Off topic: instead of you writing on behalf of SIL, your SIL should write. The person undergoing could explain the details enabling people to suggest better. Whenever third party is involved there is always a communication gap
