My story is, came here in 2012 with a K1 visa. Got married, had two kids. Have been separated for a year now and on August 31 2013 was when I first received my green card, so I am elegible to apply for citizenship 90days prior to 5years right? I’m living with my sister in an apartment and he is living with his girlfriend of two years , you read it right. Anyhow won’t finalize the divorce anytime soon, as I said It’s been a year now that we’re living apart.

My oldest daughter is 3years old and my youngest is 9months. Both born is US.

Can I apply for citizenship by August? What are the chances that I will be rejected?

The marriage was entered in bona fede, I loved the guy and thought I’d spend the rest of my life with him, he just changed into this person that is all about him, amd I have two kids to think about, couldn’t stay there anymore.

Can someone help please? I could also wait til everything is done with the divorce, I just want to know options and what obstacles I might encounter?

Thanks in advance, Angela

hi

as long as you are filing under the 5 year rule, there is no problem, since it is taking a long time, y might end up being divorced by the time you have your interview, so you just take a copy of your divorce decree to the interview

If you are applying under 5 year rule, it really doesn't matter if you are divorced, separated, or married. If your divorce happen after you sent your application but before the interview, just bring your divorce papers. The officer will update your application at the time of interview. Overall it has no consequences to your application process.
