Greetings!

I'm the foreign fiancee and I have two questions regarding the DS-160.

First, backstory: before fiance and I got together, we were very close friends, as we're both the exact same brand of nerd. We wanted to meet each other face to face. So he invited me to come visit him in the USA, since he could afford it. Due to his personal situation it was more convenient for him and his family if I traveled there and not the other way around, but I was broke... (still am lol). I filed for a B2 visa and they completed an Affidavit of Support Form I-134 for me. The visa was refused because of the lack of ties. So he came to visit me twice later on. We hit it off wonderfully during the visits, so we decided to get together, then we decided to make it permanent, and now here we are, filing for a k-1. Petition was approved, now we're onto phase 2.

Now, my questions are:

1) In regards to: "Has anyone ever filed an immigrant petition on your behalf with the United States Citizenship and Immigration Services?" - Does the affidavit of support, form I-134 count as a 'filing an immigrant petition on my behalf with USCIS'? 

2) In regards to: "Have you ever been refused a U.S. Visa, or been refused admission to the United States, or withdrawn your application for admission at the port of entry?" -- Obviously here I will say I got a B2 visa refused, and if the reason is asked, then I will answer "214-b". In the application of that B2 I said my then-friend and his family were my contacts and that I would be staying with them. Could this affect anything?

An I-134 is not an immigrant petition. It's not even a petition...it's an affidavit...for a non-immigrant visa.

Also, it had no effect on their tourist visa application. Nobody can sponsor a tourist.

 

214(b) is fine to list as the reason. I doubt the listed contacts will be an issue, although the CO may match up the application and relationship timelines and ask about why you weren't listed. Always be honest.
