I am a U.K. citizen married to a us citizen. My husband currently resides in the US while I am in the U.K. We applied for the I-130 2 months ago and are waiting for approval. However our circumstances have changed and it looks like we are going to be staying in the U.K. for the next few years (after I apply for a visa for my husband).  Can anyone advise me what I should do about the pending I-130 application? I don’t want to cancel it as we are still in a relationship. Is it possible to withdraw the application when it gets to NVC stage or even put it on hold? Would this have any consequences for me visiting the US in the future? I can currently visit under the VWP.

Hey, You have still 4 to 5 months in approval & after approval case will forward to NVC and this where you can hold your Application for 1 year and the other option is to withdraw which is possible at USCIS, you have to contact USCIS helpline and ask them to make request for withdraw the I130 petition. And I think you might be need to write a letter to your service center who is holding your petition now.

  • 05/07/2018 - Documents Mailed to NVC
  • 05/10/2018 - NVC Received Documents ( SD )
  • 05/15/2018 - Case Completed - ( CC )
  • 06/01/2018 - Interview Schedule For 07/08/2018
  • 07/08/2018 - VISA APPROVED
