Hello there!

Did you ever get an answer to your question? We have an unusual step-child question/situation as well.

My husband is applying for his N100. I have 4 children from a previous marriage. It states on the online N100 application to include stepchildren. This is where we are scracthing our heads... 2 of my children/his stepchildren are adults and live on their own. The other 2 live with us. When it comes down to evidence, it states "upload documentation of your parental relationship to each child. Makes sure the text is readable. This may included the following: birth crtificate, court order naming you as a child parent, final adoption certificate or decree. "

So really, none of those proofs pertain to stepchildren.   What is a person to do?

I have a similar situation with step-child. I am planning to file for N400 online in May. My husband has a son in previous marriage. We have just a copy of the passport for the kid, but no birth certificate listing two parents. Not sure if birth certificate is a MUST. We have my husband’s  divorce decree with his ex-wife, the name of the child and the date of birth is listed there... I am not quite sure though, if this is sufficient evidence for them.

Not sure where you all live, but your husband can request a copy of the birth certificate from Vital Records Department if he lives in the United States, regardless of custody situation. At this point we are attaching all of my children's birth certificates as step-children children for my husband's N100. From there if they can't figure out that my daughters at age 22 and 24 have a different address not because of a custody situation but because they're grown up, then USCIS can deal with it. Almost ready to upload the electron microscope photos our three frozen embryos with letters from how are fertility doctors if they're going to make it such a big deal about children LOL
