Last year I recalled that the date was coming soon and saw that I actually still had 6 months since my wife's is expiring in the middle of March. As the holidays came and went I spaced the timing and a few days ago got really nervous 

 

Just today, to be honest, I have begun preparing and pretty much have the necessary documents but I'm really nervous since most people on here have filled as soon as they were able to. Has anyone else filled a month before or is it also okay or is it better to have filled right away? Any recommendations?

It’s fine so long as you apply sometime in the 90 days before the conditional card expires. Most do as soon as possible just to get it out of the way and the ball rolling on the wait times.

Don't stress! People on VJ are overachievers haha - I'm waiting for my 2017 tax transcripts to file, so I'll likely be weeks into my 90 day window.  It's generally better to file earlier since some ROC's can take over a year to be processed, but there's no penalty or anything as long as you file w/in that 90 day window.  Best of luck!

You guys are helping me feel a little more relieved. 

 

A few questions since you guys have been so kind to reply.

 

1) Once I send out this stuff does that mean my wife can't leave the country until it's finished? or if she does leave is she going to have a difficult time getting back in if it's not all finished by then?

 

2) Also, 

I looked at a lot of posts of what you were saying is an overachiever, which sadly I am not and what is a must? in terms of documents? because I was looking at the instructions and according to that it doesn't say all that stuff is needed so I don't know if people are going overboard or if some of that stuff is required but maybe not listed?

 

 

3) On form I-751 on page 1 item 12 it says place of marriage, we got married in Korea and the US, should I state both?

 

4) on blanks, such as an additional family name, or information about children that doesn't apply should I write N/A or just leave it blank?

 

5) On part 7, item 6a, should I sign electronically with Adobe or should I sign or print with a black pen?

 

Sorry if some of these questions are obvious to others, but the help would be appreciated

1) She can I would suggest that she waits until you get the acceptance letter (NOA1) after you file to say that they have received your application. This serves as her extension letter once her card is expired.

 

2) Evidence of commingling of assets, rental agreement or mortgage documents, bills in both your names, medical insurance.

 

3) marriages overseas are legal in the us, why did you get remarried. In a lot of states you have to swear you aren’t already married in order to get a license. Were you legally married overseas before getting a fiancé visa or did you get married again after coming here on a spousal visa.

 

4) for her name I would leave it blank as you don’t want to accidentally end up with n/a for a middle name but for kids I put n/a. 

 

5) Print it out and then sign, they don’t accept digital signatures.

 

6) 1 print and 6a sign

This means you got married in the US, so write down whatever the location is on your marriage certificate. The second marriage in Korea is not considered a marriage, you should probably phrase it as a second wedding reception.

And I applied to ROC about one month into the 90 days period, so that's 100% fine.
