I-864 QUESTIONS RE: INCOME

Ok people, need your wisdom here. We're filling in B's I-864 as primary sponsor and come across a couple of questions that have us like :unsure: .

So here they go:

LINE 22. EMPLOYED AS.... he is a graduate student, so we wrote that down (we will attach a letter from the U. saying he is indeed a full time student there). Is this ok? Said letter will also be included as proof of temporary domicile in Canada (we plan on moving as soon as we get the visa, since he is just stalling graduation for said purpose he he :whistle: )

LINE 23. MY CURRENT INDIVIDUAL ANNUAL INCOME IS ..... (what the heck do we put here? In his last IRS tax return the amount of gross income is utterly laughable). Do we put the income reported to Canada Revenue? We are at a loss. In the FEDERAL INCOME TAX INFORMATION we will put exactly what's on the returns.

Mind you, we have a joint sponsor that alone has no issues when it comes to being more than capable of supporting me (not that it would happen, but we already have his forms and tax info and all).

So, folks, waiting for your wisdom here.....

p.s. L is getting a root channel on monday... not amused. :angry:

The answer to current annual income is the same answer you would give if I asked you. If you take start a job today with a salary of 60,000 USD, that is your current annual income. It doesn't matter if you made a dime last year. If you lost your job yesterday, your current income is zero. It doesn't matter how much you made last year. If you just got a raise to 60k from 50k you made last year, your current income is 60k.

The answer to your question is that you tell the truth. You apparently need a co-sponsor anyway, so don't worry about the impression the truth gives.

Facts are cheap...knowing how to use them is precious...

I'm confused as to who is the Sponsor preparing this I-864. First you write that it's B's I-864 (Bren's?), then you write that "he" is a graduate student (Len?) In any event:

Line 22: So he's a graduate student, does he have any employment? Employment is what the question asks for. If none, say so, and perhaps add parenthetically 'graduate student' if you wish.

Line 23: Answered by pushbrk.

Why does whoever want to prove temporarty domicile in Canada when what they need to prove is US domicile? Seems to me this approach just makes it all the more difficult to prove what needs to be proved.

I agree with the answers you've had so far.. Employed as.. well, if he gets a stipend for being a TA or something, that's employment. Current income is whatever it is, laughable or not. :) Mine was 'zero'.

Indeed, Bren (USC-man of the house) is the graduate student - not having any bursary or job as TA this year (just doing research). We did report his income to both Canada Revenue and the IRS... so I guess the question is, do I simply translate into USD what was reported to CRev. or do I put in the line of gross income from his IRS-1040? I get all tangled up between net income, gross income, taxable income AAAAAAAAAAAAAAARGGGGGGG :angry:

As per domicile, the I-864 instructions say one should indicate the USC domicile abroad is temporary and under which "classes", including pursuing studies in a foreign country - that's why we would think of annexing a letter from the U. He has -for now- no domicile in the US, exception made of an old checking account in Utah, and my inlaws place of residence.

Any more input would be greatly appreciated, and sorry if I sound completely idiotic, maybe I am. - But I rely on you guys for advise.

Thanks for straightening me out on the who's who.

The I-864 asks for 2 things with regard to income - current income and past income as reported on income tax returns. Understand the difference and put the right information in the right place.
