My boyfriend and I are looking to apply for a K-1 visa and I have a few concerns. We met online four years ago, and I later met him in person in 2016 while I was studying abroad in Ireland. (He's British but he flew over to meet me). We ended up visiting back and forth during my time in Dublin and the rest is history. I graduated college last year and at the last minute decided to pursue my master's overseas, there were various reasons for me choosing to do so and obviously he was one of them. :)

We moved in together last September and I'll be working on my master's until September of this year. We recently agreed that when I'm finished with my degree we want to move back to the states to start our lives together. (He flew over for 3 weeks to come to my graduation, so he's already been to the states to see me before) However, I will be starting the K-1 application while living here in England. I was just curious if anyone else has experienced a similar situation? Will me living abroad during the process negatively affect his chances of getting approved for the visa? I was planning on filling out the I-129F and mailing it to my mom (as she will be a co-sponsor on the application) for her to send to the Dallas lock-box facility, but I don't want them to think I'm trying to deceive them by doing it in a roundabout way. Sorry some of my questions probably seem a bit silly but I'm really nervous that anything I've done might compromise our application.

Hi there,

 

My fiance and I are currently in the process of applying for our K1 visa from outside of the US. I am the beneficiary and he is the USC (US citizen) petitioner. We are in the middle of our process but I can tell you from reading these forums that it will not matter that you file from overseas. You can have your mom send the application or you can send it by courier to the Dallas Lockbox. It doesn't matter. They won't think that you are deceiving them because upon reading your I-129F packet it should be clear to the adjudicator that you are living abroad. All the evidence should really clearly point to you living together and that you, the USC, are temporarily residing abroad. However, you have to keep two things in mind. 

 

1. You have to be able to prove domicile in the US or the intent to move back. For you, this should be easy since you went there to study. Search the forums for "proof of domicile."

2. Since you are residing abroad any income that you might have now will not count toward sponsoring him. As you pointed out, you need a co-sponsor. Just make sure that you read the requirements for minimum income on the Health and Human Service's Poverty Guidelines.
