RFE I-485, delayed EAD?

I applied for I485 and I765 in february and I have had my biometrics apointment, however I recieved a RFE ( or "request for intial eveidence") for a missing tax form in I485.

On the RFE form it said " You are ineligible for interim employment authorization........until 90 days after the missing inital evidence is recieved" Does this mean my EAD will be delayed?

has anyone else had this?

It will be delayed by the amount of time that it takes you to send the info back to them, that "delayed for 90 days" thing is most often not true, there have been plenty of people who got their EADs within 90 days of submitting their original application despite an RFE.

We got the same RFE. We sent them the information they wanted, only our tax info was there, I called the IRS and ordered my transcripts to send...the EAD processing continued and my husband was approved within the initial 90 days stated on the EAD application. It will delay it as long as it takes you to send them the requested information.

I too had an rfe for same issue-I got my EAD in 75 days! I sent my rfe evidence like 2 days after I got the letter. good luck

2/28 EAD approved, got in mail 3/4

still waiting for interview notice!

EAD renewal sent 11/19/07 NOA 11/28/07 bio appt 12/19/07

353 days since I filed! finally got IL 12/4

interview scheduled 1/9/08

recv'd EAD renewal 12/31/08

recv'd welcome letter 2/9/08

recv'd GC 2/12/08

petition to remove conditions I751 filed Nov 5 / 09

received NOA and extension of conditional card for 1 year Nov 11/09

biometrics appt Dec 11/09
