My husband and I currently live in Australia. He is a US Citizen and I am an Australian Citizen. We've been married for 1 year and 3 months and we are wanting to relocate to the US, specifically Georgia. I am so confused on which visa I need to apply for. I've been doing research and have found the K-3, the IR-1/CR-1 and then the DCF. Which would be the correct to apply for? And what is the cost involved? Thanks so much for your help!

DCF doesn't apply to Australia.

K-3 is as good as obsolete.

So it would be the CR-1 for you (although by the time you receive your visa you will have been married more than 2 years so it will be an IR-1).

 

The whole process will take 12-14 months. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Okay cool - so I apply for the IR-1 now, even though we haven't been married for more than two years? Is that correct? And does that mean that I have to wait until the visa has been granted until I can move to the States? What about working - Does that grant me the right to work also?

If you have been married for 1 year and 3 months, if you file now, by the time you get the visa you will have been married over 2 years. So it will be an IR1

 

You can visit during the process. But you cannot move to the US until you have your visa.

 

Once you enter the US with your visa, you will be given an I-551 stamp in your passport. This will serve as temporary proof of residency until you receive your physical green card. This gives you the ability to work right away.
