His 21 and 2 months , country morroco and I'm lpr

your son PD is July 2016 and so i think he ages out. They will remove your son category to F2B. I'm sorry but there is nothing you can do to help him in this case.

You don't even know how long it took him for approval . You know that comes into play don't you ?

You have to look at  Chart A Final Action Date ( this is when your son visa will be available). For November 2017, chart A shows 15Nov15, and your son PD is July 2016. As you said your son is already over 21, which means he will be in F2B.

That's not how Capa works sorry

  • CSPA allows the time a visa petition was pending to be subtracted from the beneficiary’s biological age at the time of visa availability so that the applicant is not penalized for the time in which USCIS did not adjudicate the petition.

Youre right so they subtract the time the petition was pending .which took me almost a year

The time you submitted the I-130 and when they approved it. Not the time you wait for your visa to be available.

For a definitive answer on whether CSPA can help someone you need to provide:

- The filing category (already stated to be F2A)

- Birth date

- Priority date

- I-130 approval date

- The date on which the priority date became current in the Visa Bulletin

I KNOW.THE TIME THE PETITION STAYED AT USCIS OR CALIFORNIA SERVICE CENTER IS 11 MONNHS .I know all that things .

If you know it then you can figure it out.. looks like it will be a close call.. if the visa availability moves like current then he might get in...  Now he is over 21 that's why they put the case in to CSPA review.

I was asking how long the review can take , the nvc told me it can take up to six week , but the thing is the visa  won't be available in six weeks , so how can they figure out if I'm f2a or f2b if they don't have visa available,  remember in order to figure out the cspa you need actual age at the time if visa availability also when I called they said they have every thing now to go ahead and do the math . So my quastion is is their anyone with experience who get to know what category is he/she in before chart  A be become corrent . ?

We are all trying to help you here, but you haven't given any information in order to help you.

_ Birth date

- Priority date ( you said July 2016)

- I-130 approval date

Back to your original question, NOTHING you can do here to help your son get here sooner. it only would help him when you changed your status from LPR to US citizenship ( before he turns 21). At this time, you just have to wait from NVC.
