Dead end - No Infopass Appointment after 45 days' effort

Hello :  
We are awaiting final decision on I 751 filed on Dec 08, 2017 filed by US Citizen  for spouse on Conditional Residence post marriage : 
- Bio-Metrics done in Jan 2017
- Current Processing Date is July 29, 2017
- One Year Extension to Conditional Residence is Expiring on Jan 15, 2018
- In Sept 2017, We were told during on Phone Inquiry to USCIS that : we should get Infopass Appointment on Local USCIS Office and get the Further Renewal stamp on spouse's Passport

   for another One year 
- Since 23rd Sept 2017, I have tried every "odd time" to get that damn Infopass appointment from local USCIS Office but, No luck in last 45 days 
My Q is : 
- Can we go to other than the Local USCIS Office to get that Renewal Stamp on my spouse's passport ? 
If Not : Then, what are the options as USCIS Customer Services Person keeps parroting on the phone inquiry : "Keep Trying" !!! and despite "Keepin' Trying" we are NOT getting
               that damn Infopass appointment at local USCIS Office even after 45 days !!?? 
              As Extension of Conditional Perm Residence is expiring on Jan 15, 2018 - is there anything we can do to wake up USCIS ??

Seriously.

 

Honestly, I have probably had more infopass appointments in the past 2.5years than most, and I have done them all over the US.

I did three in two weeks recently, at one of the hardest offices to get an appointment, and all were made online,

 

Midnight - just before or after, is the usual time of release, on sunday thru thursday nights. I have also seen them released as early as 9pm, and as late as 8am, and at random times like 1 or 2am, or 4am, and sometimes at 1pm. 

The NY office did a few weeks ago oddly release two weeks worth of appointments all at once on a monday morning, but that is the exception.

There are infopass appointment kiosks at USCIS offices, but these usually only show the same availability as online, so aren't much help either.

You could always put in a different zip and go to a different office.

 

Bottom line, keep trying, but don't keep trying the same method, as it obviously isn't working.

The extension letter is your proof of status and not the status itself. If it expires without a stamp, you remain a LPR. There is nothing you can do until you are considered outside of normal processing time.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

 I-751 Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Thanks much for the inputs ; Finally at 3 am in the morning, I was able to get the appointment !!

However : 

   - Yet, another bad surprise (beside having to put so much efforts just to get the Infopass appointment!!) from USCIS : 

                  After checking  all relevant documents,  following was the conversation with USCIS Officer 

                    ( Through out the conversation, I have maintained Absolute Calm composure - just for the record !! )  : 

                  USCIS Officer to me : Does she have any Travel plan in next 2 months ? 

                  Me : Yes, she wants to Travel to UK but, she is stuck without this renewal ( which is fact as she plans to travel to UK during X'mas!) 

                  USCIS Officer :  I am sorry I can not do anything today, As I do NOT have the Stamp which is to put on  her (my Wife's) 

                                              Passport !!!????!!!??

                  Me : Is it because, that, we are missing any documents or is there anything missing from our  end  ? 

                 USCIS Officer : No, you are not missing anything but, since I don't have any stamp as of now, you should come back Post 

                                            Thanksgiving !!

                 Me   : Would you have Stamp by then ? 

                 His Answer :  We will see !!??!!

                 And adding  Insult to "Injury" ..He says : By January 15, 208 ( it is a date when the Conditional PR of my wife expires as per One Year

                                                                                           extension !! )  she can apply for citizenship !! 

                  My Reminder to him :  My Wife's Employment is at stack ( which is fact, as HR Person keeps asking about further renewal post

                                                            01/15/18 !! every few days since last 1.5 months !! ) as  the expiration date is coming near !!? And she Needs

                                                             Proof of LPR ASAP !! 

                   USCIS Officer :  Come back Post Thanksgiving and we will see what we can do !! 

      - And that was it !!  AFTER  enormous effort of  just to get that damn appointment !! --- No solution at all !!

      - After reaching to home : It took me only 10 minutes to find out  USCIS Circular to Its own officer  Directing them to Put the Renewal 

         Stamp on Peron's Passport who is in similar condition ( 2 PDFs attached with highlighted text of that circular !!)  !!! 

      - Rather than putting renewal stamp - why would he talk ir-relevantly about My wife's eligibility to apply for US Citizenship where as

                                                                         technically (although NOT  out of LPR  beyond 01/15/18 even that stamp is not there on her

                                                                         Passport !!)  she has NO proof of her LPR status in US Post Effective 01/15/18 ??

         - And that too : After reminding him that, my wife's employment is at stake ??

 Again after Few Late Night / early morning 'endeavors' ...I just now got another appointment post Thanksgiving ..

 My Q Is : What that USCIS Officer is Up to ? Is it possible that in this Good Old USofA ..the Govt. USCIS Office would NOT have a Renewal

                Stamp?

               - Should I show him the Print out with highlighted text where US Dept. of Homeland Security is asking its Officer to put the Renewal 

                  Stamp on Applicant's  Passport in such cases IF he  again refuses to put that stamp on her passport for some non-sense reason ? 

                           OR It would be kinda Offending him  : I do NOT even care if he feels offended .. !!

                                 What I care is  DO I HAVE Right to  Push back such nonsense if it happens again  during next appointment ?  

                                       ...by showing him his own Agency's  Circular which clearly states what he supposed to do in such cases ??

Sorry for the long post -- I am REALLY Pissed off !!  We have a feeling that, he was just fooling with us !!  I neither have time nor tolerance for such kind of  'who cares' attitude from USCIS Officer even when nothing is missed / in violation from our end he knows that my wife's hard

earned employment is at stack and her travel plan is in limbo  !!  

 

Your thoughts / opinion  is  highly appreciated .. ( I am in this country since 20 years ..everything's going down here for sure !! )
