Hi there,

 

These forums have been really helpful in preparing our I-129f and we are just about ready to send our package off to the lockbox in Dallas.

 

I do have a quick question though about which divorce document to send. I'm in North Carolina and my uncontested divorce was final on 10/3. I've received the "Judgement of Divorce" document from the courts that says the date it was filed, has a stamp for it being an original document and is signed by the judge after the following statement...

BASED ON THE FOREGOING FINDINGS OF FACT, THE COURT CONCLUDES AS A MATTER OF LAW that the Plaintiff is entitled to a divorce from the defendant. There is no genuine issue as to any material fact in this matter.


IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that the bonds of matrimony heretofore existing between the Plaintiff and the Defendant be, and the same are hereby dissolved, and the Plaintiff and the Defendant are granted an absolute divorce from each other.

After the above statement, there is a "This the 3rd day of October, 2017" line and then the judge's signature. 

 

Can anyone tell me, is this the document I need to send with my packet or do I need to go to the court and get the more "birth certificate" looking document that just has the basic vital records and has the certification from the clerk of court that "the above information was abstracted from court documents is true and correct"?

 

Any advice or info you can offer would be appreciated. Thanks for all you do to help people like me get through this process!

You should have a certificate of absolute divorce or annulment. We provided a 6 page divorce document that had been stamped and included the certificate. 

 

That’s what my fiancé had (he’s from NC as well) and we were approved, no RFEs :) 

K1 & K2 Visa 

 

18th April 2017: I-129f sent

21st April 2017: NOA1 Received Date

25th April 2017: NOA1 Notice Date

26th April 2017: NOA1 text confirmation

2nd May 2017: NOA1 hardcopy

7th September 2017: NOA2 Approval date

21st September 2017: NVC Received
21st September 2017: NVC Case # Received

27th September 2017: Left NVC
27th September 2017: Case Ready

4th October 2017: Medical

12th October 2017: Interview

24th October 2017: Visas in Hand

27th October 2017: POE

16th December 2017: Wedding Day

Thanks so much for your reply Salty! I hate to be a problem child because I feel like this should be obvious, but I went to the Mecklenburg County Courthouse after posting, and the attached images are what they gave me. I asked for a "certificate of divorce" and showed them this form (http://www.nccourts.org/Forms/Documents/1429.pdf) which I filled out and included with my divorce case and they said that form was for internal use by the clerk and that it wasn't something they provided to the public. 

 

Do you guys think the attached judgment signed by the judge and certified official will be sufficient proof of my being free to marry again? Just want to get this right the first time I send it.

The "Judgement of Final Divorce" one page, stamped true copy, is exactly what I sent in as a divorce decree.

Thank you SOOOOOO much for getting back to me. I feel so much better about sending this in next week now!
