Part 6, item 1: RE step-children.

 

Hello,

 

I am currently filing for AOS, I am the K1 holder. My husband has two kids from a previous marriage, his ex-wife is the custodial parent so has them in her care more than my husband and I do. I have not legally adopted them and have zero intention of doing so. I don't have any children of my own, so have put zero under number of kids, but do I need to write their names in the step-children area? I don't know if legally I automatically became a step-mother when I married by husband, though I feel not. Can anyone please clarify?

You don't have to legally adopt them for them to be your stepchildren. That relationship occurs by way of your marriage to their father. List them under the children section and specify the relationship as "stepson" or "stepdaughter".

 

The form does say any children - biological, legally adopted and stepchildren, whether born inside or outside the US, married or unmarried, living with you guys or not. So yes! :)

Thanks. We were going back and forth on what’s considered a stepchild and it was late. Just from a logical standpoint I think the safer bet is to include them if unsure. It’s amazing that there’s very little information online about the legal definition of stepchild. Anyway, thanks again.

 

If anyone else has any personal experience with this part of the form (leaving it blank and being questioned about it at the interview, etc) I would love to hear about it.
