Hi everyone.  I just have a few questions if you guys can spare me some time. 

 

Here's my situation. 

I'm 25 and my boyfriend is 23 turning 24 in Dec. I lived in the Philippines and dated him for about a year and 9 months before moving back to California. We have so many pictures with me visiting his fam and him visiting mine. I was born in the Philippines but I'm us citizen cuz my dad was a us citizen.  So now I miss him so much and I just want to be with him so we decided we want to get married. So here are my questions. 

 

1. Do I need a lawyer? Or is my case simple enough? 

2. Should we do fiance visa or should I go back to the Philippines and marry him and then petition him here? 

3. I just started working here. I have two jobs and I make 2300 dollars a month. Is that enough for me to petition him? I've been working since June. So that means my income tax papers won't show that I made enough. Will they accept my estimated income for the next year while I'm petitioning him? 

4. I don't have naturalization cert. Or anything. I just have my US passport. Will that affect anything?  Oh, and also I am dual citizen. I also have Filipino passport. 

5. I'd like to start the process now. Cuz I know it'll take a while, so you guys think it's a good idea? Or should I wait until I've saved more money? Currently I'm saving 1000 dollars a month so hopefully by the time he comes here we can have a nice simple wedding. 😊 

 

So yeah, I think that's all the questions I have for now. I'm just reading through this website to  get more advice, but I'd like some advice specific to my situation. Anyways, thanks! 😊

 

 Oh BTW, we've both never been married. We're both super inlove. I swear we can't have a conversation where we don't tell each other how much we love each other. Haha. It's sickening.  Both no children. Both catholic.

Doesn't sound complicated but photos alone is not enough. You will need more supporting documents for your petition. Refer: http://www.visajourney.com/content/k1guide and instructions sheet https://www.uscis.gov/i-129f.

Totally up to you. Compare and decide. K-1 takes at least 6-8 months to have visa in hand whilst CR-1 takes 12-14 months but will be admitted as a conditional PR upon entry.

If you are petitioning in 2017, you'll be calculating your current year's expected annual income. You'll need employer letter and paystubs to prove what you're earning. Poverty guideline: https://www.uscis.gov/i-864p. If you do not meet the poverty guideline for your household size then get a co-sponsor.

No idea if your US passport alone is sufficient. Others will comment.

You can start at anytime but remember there will be more than just I-129F/K-1 ($535 for I-129F excluding other expenses and K-1 visa application costs) and wedding costs. You'll need to think about his AOS + EAD +AP application after getting married and that's an additional $1140 + biometrics $85.

 

So yeah, I think that's all the questions I have for now. I'm just reading through this website to  get more advice, but I'd like some advice specific to my situation. Anyways, thanks! 😊

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

I didn't show my Filipino passport because the U.S doesn't recognize dual citizenship. Just sent copies of all pages of my US Passport and Birth Cert.

 

Since you are a dual citizen, you will also need to provide a CENOMAR when your fiance goes to the interview.
