Good morning , I am currently trying to fill out the applications to adjust status and had a couple questions. I can't afford the prices some lawyers are asking to fill out some forms so I am doing my best by researching some of the information and asking on forums questions I don't know.

 

I currently have DACA and got married last year to a U.S. Citizen. She doesn't make enough for form I864 so we will be using my income as well. The questions are as followed...

 

We filed last year jointly and we claimed my parents as dependents. Does that mean That I would need to also file form i864a ? or would I be able to choose the option that states "One or more of the people listed in Item Numbers 3., 6., 9., and 12. do not need to complete Form I-864A because he or she is the intending immigrant and has no accompanying dependents. " ....even though we both have my parents as dependents , but they are not being requested on the AOS

Lastly, would it be an issue if my wife only provides the past two irs forms for the previous years, since that's when she started working. thank you.

First, people who provide professional services usually do more than fill out forms, because there's more to the process than that, as you are now learning.  Professionals are usually paid for their knowledge of HOW to guide you through the process, which includes "forms".

 

You would only get an I-864a from a dependent or other household member if you needed the dependent's income to qualify.  Otherwise, you simply count them in your household and must have the income needed for your full household size.  Since you are the intending immigrant, you do not provide an I-864a.  Even if your parents have income, you only show it and provide an I-864a if that income is needed to qualify.

 

Doing it yourself, means you must learn the process for yourself.  If you don't understand the process, you won't know what you don't know, won't know what to ask about.  Your above question is excellent and well asked.  The answer I gave you is based on the kind of "knowledge" you would otherwise be paying a "professional" to provide. j;)
