My fiance who is currently working in Hong Kong is really at wits end with her employer. Our I-129F paperwork was sent in during the month of May, and is in the NOA1 stage, her current employer and living address in Hong Kong is what listed on the application. She's considering terminating her contract and returning home to the Philippines, my question is this.. Will her returning to her country create a problem with the I129F application? We're just trying to figure out if there's a potential issue with her doing so.

It won't be an issue for the I-129F if she changes employers. The I-129F was accurate as of the time it was filed, so that's fine.

 

The only issue I foresee is that if she will no longer be a resident in HK, then she will need to have the case transferred from HK to PI. Unfortunately, this can only be done after the I-129F's approval / NOA2. If you're lucky and catch the I-129F while it's at NVC, you can try to get them to make the change at that time. I didn't have any success in this (18 calls, askNVC submission, etc.), but a small few have. It's only at NVC for about a week usually. After that, the case is sent to the embassy. Once it arrives, she can contact USEM and request that they transfer the case from the HK embassy to USEM. Then you need to wait for them to acknowledge the request, get it approved, then for the case to actually transfer from HK to PI. Checkout my timeline in my signature for my personal timeline with this...it's only 1 experience but it's better than nothing to gauge timelines.

She intended to go to the Philippines when the NOA2 came through anyway.. not sure if that matters that I have her mailing addy in PI for any further documents to be sent to her, and I listed Manila as the embassy.

So you wrote Manila on the I-129F already? Then ignore the second paragraph...no need to transfer. You're good. No need to do anything. If asked about it at the interview, she just needs to tell them she left her job in HK. Best wishes!

Correct, I used Manila as the was the plan all along.. thx for the input!
