Hi,

 

I am overdue on applying for my USC.  I've been here for 7 years already.  My husband owes back taxes.  I never work here and we file jointly, am I affected on his back taxes? I've been researching about back taxes and learned that you have to make payment arrangement and stuff like that but I wanna make sure if I will be in trouble since he owes the IRS before I get here.  We are getting a refund for 4 years now and it's just automatically goes to IRS for payment. 

 

Is there anything else I can do to be exempt on this? I don't wanna take the risk to file for my USC and get deny.  

 

Appreciate any help.

it's common sense that ,in order to file N400 on the earliest time, you should start to be  and maintain to be a good "citizen"( person) in all aspect, no dirty history to stop you from applying for N400. There do have some red flag case by case when filing N400. 

 

To the Tax , your tax record actually represents and prove that if you or your couple are responsible enough for your obligations with the US government.,paying your income tax and on time.    Since you couple has back tax history and still not paying off all the balance, this may raise the challenging questions during your interview, why owns the government's TAX money ?  i think it's an embarrassing moment during the interview.  You may not simply say, “i am not working in the U.S. and dont own the tax money but my husband does.”  No, you have the family responsibility in this marriage to help your partner to solve the financial problem.   there is no answer if your application will be rejected simply because of this tax issue. it totally depends on the IO's mood and particular field office you are with. 

 

if i were you, i will first file the application and stand in the line. Meanwhile, try to find ways(finance with your bank or borrow money from family,relative or friends ) to pay off  all the tax balance as quickly as possible before your interview( 3-4 months after biometrics).,which leaves you with no tax debt issue anymore.

check with your local bank, credit union, loan lenders for possibilities. i receive 3-4 different mails every week in my mailbox asking for choosing their loan, money lending services etc. even it's not for buying property, education. they are willing to give you money simply because of your financial hardship and need cash. 

 

They run your credit and other things,then cash you the money. You pay off your tax balance before interview,as that's the priority in your life and you have been waiting for this moment for 5 years so far.  Try your best to make this happen. Later, you pay the interest to the private lender/bank from your daily earnings. Simply...!

 

you definitely will be appreciated for someone lending money for you and charge you interest. The same as financing to  buy a new car.!
