Name and Address questions on new form I-130

Hi - 

 

We have decided to file for permanent residency for my parents. They are currently in the US on B2 (Visitor Visa). They did not enter with the intention of immigrating, but we have now decided to file for their residency. They will be adjusting status here in the US. I am preparing form I-130 and have a few questions - would really appreciate your guidance. 

 

Part 2: Information about your parents:

Parent 1's Information: 

28: City/Town/Village of Residence

29: Country of Residence

Parent 2's Information

34: City/Town/Village of Residence

35: Country of Residence

Since my parents technically reside in India - until the permanent residency application is approved - should I be entering Delhi, India as their City/Country of Residence? 

 

Part 4: Other Names Used (if any): 5a, 5b, 5c

I understand that we have to mention my mom's maiden last name, first name, and middle name here. But, one additional question I have is this: some of my mom's documents has her first name shortened (ex. Geeta vs Geetabai). Should I add "Geeta" AND "Geetabai" in the first name field for Other Names Used? If yes, should I separate that the two names with a semicolon (Geetabai; Geeta) or some other separator?

 

Part 4: Beneficiary's Physical Address: 11a - 11h

Since my parents are in the US, this will be their US address (they are staying with me), correct?

 

Part 4: Part 4: Other Address and Contact Information 

Provide the address in the United States where the Beneficiary intends to live if different from items 11a - 11h. If the address is the same, type "SAME" in item number 12a. 

 

This makes me think that Beneficiary's Physical Address should be in the US in 11a - 11h and I will type SAME in 12.a.

 

Would really appreciate your input.

If Geetabai is her full legal first name, that goes in the First Name field.  Geeta would go in the Other Name Used field.  If there is a third "other name" attach a separate sheet explaining so.

Yes.

 

 

All that said...moving into AOS from a visitor visa is a tricky thing sometimes.  You have to ensure that your parents are able to prove beyond a doubt that their original intent was not to immigrate when they applied for their B2 visas.

Aug 08, 2017 (Day 24) - Biometrics (fingerprinting) completed

Aug 14, 2017 (Day 30) - Online EGOV status shows "Interview Scheduled, will mail appointment letter"

Aug 16, 2017 (Day 32) - Online MYUSCIS status shows "Interview Scheduled, read the letter we mailed you..."

Aug 17, 2017 (Day 33) - Interview Appointment Letter PDF posted online---GOT AN INTERVIEW DATE!!!

Aug 21, 2017 (Day 37) - Interview Appointment Letter received in the mail, appointment for 09/27/17

Sep. 27, 2017 (Day 74) - Naturalization Interview--- read my experience here

Sep. 27, 2017 (Day 74) - Online MYUSCIS status shows "Oath Ceremony Notice mailed"

Sep. 28, 2017 (Day 75) - Oath Ceremony Letter PDF posted online--Ceremony for 10/19/17
