Hi everyone

I know this question gets asked all the time on here,but I am aware of the risks and just need some input PLEASE!!!

I am wanting to see my fiance in the US,we are currently doing K1,I went to see him 11 weeks and came back beginning of January this year.

I am fully aware of the risks etc.,when I go I am deffinatly going to take my Binding Ties with me( my job would give me my full yearly holiday I have at once) so I would take a letter stating I have to be back in my job in 5 weeks,my car insurance I would take a copy of that stating I have an insurance still running and a piece of paper that I am still registerd in Germany(when I leave Germany for good I will have to get ttaken out of the system).

Now my big question and yes I read the full link on here that somebody gave me...would just like to hear some opinions in your own words: If I get denied,then I get a denied stamp and go back home and have to pay the flight myself right?

One of my friends got a denied stamp before she applyed for the Visa and it was no big deal to them when she actually did applay for the Visa.

If I get denied does that mean I dont get my Visa? Is it really true that when you get denied that it will slow down the Visa process of the K1????????? - I just dont understand how it could slow down the process.

I am guessing the worst that could happen is a denied stamp and a loss of alot of money right???

After you are in the system for a K1 visa, it is apparently very risky to enter the USA. The better option is almost always for the US citizen to visit you, if possible.

But as far as I know, a denial at the port of entry does not effect the case status of your petition or the outcome of the visa. Don't take my word for this however.

Jan 24, 2007- NOA1 date

Jan 27, 2007- Check cashed by CSC

Jan 29, 2007- Paper NOA1 recieved (at permenant US address)

May 1, 2007- NOA2

May 16, 2007- At the NVC

May 18, 2007- Left NVC

May 30, 2007- Packet 3 arrives

May 31, 2007- Faxed Packet 3 stuff back

July 9, 2007- Interview at Vancouver

July 10, 2007- Visa recieved!

July 18, 2007- US entry

August 25, 2007- Wedding <3

I know my fiance visited me even after we were in the system, the file had already been sent to London Embassy and everything. He took all of his ties to the UK, just in case, but the guy never even bothered looking at them. They just let him come on through like nothing else was different. I know it's a scary thought, I was SOOO afraid I'd get a call from him in NY saying they wouldn't let him in, but everything was fine. If it is possible for your fiance to visit you, perhaps that would be less stressful for you guys, but if not, I'd probably still go ahead and risk it. Most likely, you won't get turned away as long as you have your ties to the country. Good luck!

May 15 After gathering all paperwork, told we must file through DORA program

July 19 DORA appointment - they send paperwork to Chicago after this.

July 24 Paperwork is received by Chicago

August 9 Notice for Biometrics appointment

August 28 NOAs for AOS/EAD

Sept 6 Biometrics

Sept 26 Email saying card production ordered for EAD.. YES!!!

Oct 9 EAD card, Yay!!!!!

Dec 31 Finally got the Resident card! Yay!!!

It's not generally any riskier to visit the US with a tourist visa when the K1 is in process than it is in general.. It's always up to the officer at the POE if he is going to let you in since a visa does not in any way guarantee admission to the country. If the officer believes the person has immigrant intent, he can refuse entry. Since you are pursuing a K1, it wouldn't make a whole lot of sense to enter the country as a visitor with the intent to stay permanently and logically speaking, most officers know this. A denial of entry will not affect your K1 but it will affect your wallet as I believe you are forced to pay for your return flight.

If you take all the precautions necessary and prepare yourself/fiance on how to act at the POE (respectful, calm, honest, open - yet answer only the questions asked, don't volunteer more than is required, and don't slam down a giant folder of stuff unless asked for it!), you should be fine.

A denial will not harm your K1. They are judged on completely different presumptions (one presumes you go home, one presumes you stay).

And yes, should anyone be denied, you will bear the costs of the likely SUPER EXPENSIVE immediate flight back. My fiance (then-boyfriend) was denied and he was given a simple option, buy a $1200 one-way flight home on the next flight out (left approx 2 hours after he touched down) or spend the night in jail and get on the next next-flight home. Fortunately (well, as fortunate as he could be in that situation), he was able to fly home without staying in jail. (Jail wasn't offered because he'd done anything illegal that would warrant jail, they just can't let you get a hotel room, for obvious reasons). It was a horrible, horrible experience - but there were other circumstances in play that had nothing to do with the k1 process and he was caught flat-footed on the ties-to-home evidence. We were very ignorant about things back then.

Every so often I see posts here implying that the airlines or the government will either buy your ticket or help you out. Nope. Not at all. Nor will they let you hop online and shop around. You take the next flight and you leave. Done and dusted.

7-06-07 Interview at 9:00 am at the London Embassy - Approved.

7-16-07 Visa delivered after 'security checks' completed

I-129F approved in 111 days; Interview 174 days from filing

No problems at the time of letting him in.

I think it is hit or miss...my fiance's interviewer for her tourist visa was an a$$...he wanted proof of everything, then he still denied her, he did feel bad and you could see the expression on his face, however what I am getting at is I beleive it honestly depends on the embassy that you apply at and the POE officer that you draw.

Mar. 27-Found VJ, and became disappointed for not being able to use VSC.

Mar. 27-Applied for military expedite and got congressional help.

Mar. 28-touched.

Mar. 29-touched again.

Apr. 05-touched some more.

May 15-touched once again.

May 15-NOA2. 78 days...WOW!!!
