Hi all,

 

I am an American citizen who just moved back here from Europe with my spouse.

I make 6 figures, and we can also have 6 figures in assets in an American bank. However, because I paid taxes abroad, my 2016 taxes were 0.

 

Q1: Do I need a co-sponsor?

 

Q2: If so, and since I lived most of my live abroad and don't have good enough relatives or friends in the US - how do I find a co-sponsor?

 

Any advise will be very useful.

But you reported income, then. OK. 

 

I think that there is a way to count US assets as part of the income. UCSIS says "You may add the cash value of your assets. This includes money in savings accounts, stocks, bonds, and property. To determine the amount of assets required to qualify, subtract your household income from the minimum income requirement (125% of the poverty level for your family size). You must prove the cash value of your assets is worth five times this difference (the amount left over)."

 

If you have a job now, that would count for you to be the financial sponsor too.

Is your husband doing AOS? Did he come on a K-1 with you?

I am the husband and the US citizen. My wife came here on a tourist visa but decided to stay after some deliberation and will now file for the change of status.

I have a job, earning 6 figures, as I said. However I only started this job this year, whereas last year (and years prior) I was working abroad.

Yes, you can be the sponsor. Ask your employer to write you a letter mentioning (1) start date (2) that this is a full-time job and there is no end date (3) income (4) maybe mentioning your wife will be added to health insurance? Submit some paystubs if you have any.

 

You will have to submit your tax returns. They are alright and it does not matter you pay no taxes due to tax treaty. Write a short memo explaining that you were living abroad. 

 

If you search on VJ, I remember people mentioning they were accepted as sponsors after getting a new job right out of college. Your situation is much better than that.
