I-751 Interview now mandatory?

My idea was to ask whether there is change in policy for selection of cases for interview?. Earlier they use to devide all cases in three cetegories A B & C. They would randomly pick people from all the cetegories wherein even perfectly normal and strong cases will also, as a matter of rendemness, will get interviewed. Is there amy change in this policy and now people with some defeciencies or being a suspicious case (some reflags triggering) are now being interviewed. Does anybody have any idea about this?

Lasted one hour, asked to confirm I wanted to switch to a waiver, and that i tick the waiver box and then initial it, and then write on a plain piece of paper something about the circumstances of the marriage ending and sign and date it. 

Asked for a copy of the divorce decree which I handed over.

 

She had a list of specific questions - presumably from the officer who had reviewed the petition originally  - which she asked. One of these seemed quite innocent at the time, but was in fact (as I found out at a later date) directly related to the false allegations made, that I was given no opportunity to refute or answer (as I should be, so breached their policy).

The interviewer also straight up lied to me on a couple of occasions. 

 

Some of the documents with the answers to these questions were in the file, some were not. 

I gave some more evidence - she only wanted a fraction of what I had with me, mainly concentrating on proof of travel and financial co-mingling as late as possible in the marriage.

She looked through and took a handful of photos from the multiple albums I had with me. 

 

 

 

I guess I will now have another one of these to look forward to next year, along with my N-400 interview - hopefully done as a combined interview.

This is truly an Expirience! Sorry to hear you going through this. How do you know about allegations and it's nature if they haven't questioned you specifically about it? So crazy! ! ! From what a read here on VJ  USICS only really take into consideration allegations supported by proofs and evidences, since the simple statements with no proof a lot of spiteful spouses can be spreading around in hope to complicate your situation, but it's not enough to deny your petition without proof.. that is not how it works? Or it wasn't even a spouse?

No evidence (impossible for there to be, given it was entirely false) just a statement.

I still don't know exactly what was said - only one specific part, which was directly quoted as the reason as a basis for denial of the jointly filed petition (basically 'petition was not filed properly').

I will find out all with a FOIA filing next year once my N-400 is finished.

And yes, it was the USC ex-spouse

Maybe that is refered to "switching" petitions from joint to waiver even though technically you can do this?

No, i did the switch at the interview as that is permitted!

Still denied. Made no sense and still doesn't, as does the lack of opportunity to answer and refute any allegations which should have been afforded to me, as per 8 C.F.R. section 216.4(c)(4)

I am glad there's such opportunity to switch to a divorce waiver because my spouse and I, for example, have serious marriage issues that can lead to a divorce eventually, considering how long now CSC is taking to adjudicate I-751 who knows where we are going to stand by the time of potential interview. I have to foresee  all possible situations and If we happen to file a divorce I'll have to go there by myself and I was questioning myself will I be allowed to change my case to the waiver. Now I see that it's possible. However, I will not have the final decree in my hands yet which can make it worse.

Sorry to hear such absurd things. For my understanding, let me know what all

you did after you were issued a denial letter. What about your I 551 stamps, r they still current?

Denial letter was opened on a Thursday at 11pm. I genuinely don't think I slept a single minute for the next three days.

 

A new waiver I-751 was sent on the Monday (which thankfully was a holiday that FedEx was not closed on ) and delivered to Vermont 7am Tuesday.

The cheque was cashed a couple of days later, and extension notice received the day after that.

I did an early walk-in for biometrics as soon as that appointment arrived.

At the time of denial I had a stamp that was valid until mid-2018.

However, as soon as the next extension was in hand, I went to an infopass and got a new stamp.  They wanted to leave the existing one as they said it was still current, but as it was originally issued under the denied receipt number, I wanted to be extra cautious so requested a new one.

I was given the standard one year stamp and the old one was hand cancelled without prejudice.

 

 

 

Will be a mega-thread on this next year at some point...loads of stuff has happened that isn't in my timeline.

They are bound to lose this unjustified act if the case ever comes for trial. Anyway I wish good sense prevails on them before

this.

 

Did you send full i751 revised form ?

Did you again include all annexures justifying your initial relationship alongwith divorce decree ?

Brand new form with to date information (recent addresses since original filing etc) - it is a new filing and a different edition form to the one originally sent.

 

I included a few pieces, but nothing that was previously submitted. In the cover letter I specifically listed the denied case # and stated that all prior evidence  included in that one remains relevant to this one, and noting that the original denial was not for lack of bonafide evidence.

The new filing will end up in my A# file anyway which contains the original filing, and the policy is for adjudicators to review all current and prior filings when adjudicating.

Did the interviewing official gave any hint to be uncomfortable with any issue while interviewing you.

 

Did your ex USC spouse complain against you or somebody else complained that your marriage was

not bonafied or something like that. While complain by anybody can be subjective and false, I feel

the interviewing official should have discussed the matter with you to give you a chance of natural justice.

This will go against IO. Was your interview video taped ?
