Okay fellas I have a complex situation I'll try to be as descriptive as possible!

 

we submitted our visa a month ago and I have received my NoA saying that it has been sent to the California service center. 

So my visa is now being processed and hopefully there is no faults with it. 

 

Im in the military and yesterday arrived at a new command. They notified me that I will be deploying in November which is near the point of when the visa would be approved and I would have been married. 

 

Now, I 'could' call the visa center and have my application expedited due to my military implications, so it could possibly be approved a bit sooner. 

 

My dilemma is;

We want to get married ASAP and before my deployment so that I can add her to my military stuff and whatnot before I depart the states, if not then we will be forced to wait until about may of 2018. 

Once we marry, we want her to return back to Korea so she doesn't just sit here alone for 6 months since she has never stayed for an extended period on her own before. 

 

What are my options?

im aware that once you marry you are typically unable to leave the States for a certain period of time, but given my circumstances, is there anything we can do?

Nope. If it were a spousal visa it's a different story.  With aK1 you need to adjust status.  You may be able to get the k1 expedited but you still would have to worry about the AOS stuff.  She cannot leave without AP which takes another 90 days possibly longer as of late.

 Have you applied for a K-1? It would be a waste of money to scrap it but if you aren't bothered about funds then go get married when she next visits. She plans to leave and spend your deployment in her home country anyhow. Get married, add her to your stuff, apply for a spousal visa and visit in between until you deploy then the back end of waiting for her visa is just waiting for you to return home.

Yeah we already submitted the K1. Dang. I imagined there was more options

So we just discussed the possibility of doing the cr1

 

-Would an issue come up from having k1 submitted then we just randomly got married and submitted another visa?

 

-would I be able to expedite a cr1 just like the k1?

 

-how would I stop the k1 from being processed?

Write a letter to the service center, with your case number, advising you wish to withdraw the K-1 petition. I don't believe you need to state a specific reason. If you have the time and there's an office nearby (our nearest was over 300 miles away in WA lol) you could make an info pass appointment and give the letter to a supervisor too. You'd be good to go filing the other visa. 

 

I don't believe they expedite for either unless you actually have orders. If she's going to spend your deployment in her home country anyhow is there really any point trying to expedite?
