I currently on a J1 visa staying with my boyfriend however this is about to end soon, I am wondering if I marry him and submit the I-485 will I need to return to my home country and stay for 2 years or would this avoid this restriction? I am looking for the best possible route to take here.

If you have the 2 year home HRR, then you must either:

  1. Return home for 2 years
  2. Get approved for a waiver

You cannot AOS with an active HRR, even by marriage.

Sorry about the late clarification, I am not subject to the 2 year HHR according to my J1.

You can marry on your J-1 and file for AOS fine then. That would be the legal way to stay in the US...once you file for AOS, you enter a period of authorized stay in the US. However, you cannot leave before obtaining AP or work before obtaining an EAD. Or until you get your green card if you don't file for AP/EAD (although it's free with AOS, so why not?).

Once married, your USC spouse would file an I-130 petition for you and you will file the I-485 concurrently.
