I saw a confusing question in the I-130 form which is:

The beneficiary is in the United States and will apply for adjustment to status to that of a lawful permanent residence at the U.S citizenship and immigration service (USCIS) office in: 

City: 

State:

1. My question, is the question above asking if my spouse is in the US already and will apply for change of status or will my spouse apply for change of status when he enters U.S.

2. We just got married early this month and I have not changed my name to his name yet (all my documents in the U.S. stil has my last name on it) because it might delay the filing. should I put his last name as my last name when filing or just use my own last name?

The I-130 is used for many different things, you can ignore the big about Adnusting Status, you won't need to do that.

Use your current legal name.  You are not required to change your name unless you want to.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
