I-129F question

I have never had any criminal charges, offenses, etc. Did I fill this part out correctly? Or, do I not check any box and leave this section blank?

Then to me it seems that you would select 5.d. "Not applicable, beneficiary is my spouse or I am not a multiple filer"

From how I read the instructions, yes. See page 7 of the I-129f instructions...

 

 

To be completely honest, I agree that this is very confusing, but as I read it you don't fall into the other categories (so 5.d. would be your selection since you aren't a multiple filer). According to the instructions 5.a. general waiver is used if you have never been convicted and you are submitting evidence to demonstrate why you qualify for a waiver (for example, your previous fiance is deceased or incapacitated).

 

You have never filed before; therefore, you wouldn't qualify. The whole point of this question is to figure out which type of waiver you are filing for (if you are filing for a waiver). If you haven't filed before, and you don't have a criminal background, then why do you think you would need a waiver? Most people do not require any waivers.

See if this helps. Here is the same part of the old (06/13/13) version of the I-129F. As you can see the last option has had the wording slightly to include the part about not being a multiple filier, but the lead in information gives a clearer explanation and is similar to the text that is in the instructions for the current form.

Yes, read the instructions. You must file for a waiver if:

1. you have previously filed for two or more fiances; or
2. you previously filed for a fiance and that petition was approved within the last two years

Neither of these apply to you

I filled out my forms (I-129F and G-325A) using adobe pdf reader, by adding text boxes to fill out my form. Is this acceptable? Or, no? Do I need to actually click on the lines on the form and type that way?
