That's what I understand, too. But if a non immigrant, over the age of 40, did not register, do they still need to bring a letter from Selective Services?

I was in the same boat as you. I Sent in my application on 03/02 and the check was cashed on 03/24. The FP was done on 04/24. After a long wait I finally received an update for inline on 08/22. So based on multiple calls, I was told that the process may take 8 months so I have to ride out the wait period. Since you are in FL, also have to consider any delays from the storm.

Just had my interview this morning in NYC at Federal Plaza: passed the tests, however, "decision cannot yet be made" because apparently someone at USCIS forgot to include some form in my file...the IO said it's nothing to worry about and that she can take care of it today but every time I hit a bump with this process I get a bit worried.

Yes, I asked: she said that my application "is fine" and this is not something I can provide; it's some "visa" form related to the fact that I received my GC through employment. I also asked if this is going to cause a delay and she said it won't...but who trusts these guys. More phone call and lawyer fees I guess.

Please let us know once you get more info. I am not sure whether this is a pattern, but my impression is that employment-based GC holders might face extra scrutiny. I am EB2-NIW myself, so it could be that my relatively late update to the "in-line" status (together with my wife) is related to extra verification of the GC application. Once they grant you citizenship it will be extremely difficult to reverse it without serious crimes you might have committed before you naturalize (like genocide).

It is possible, but as I said before, it is only my working hypothesis that EB applicants are double checked. I do not have enough data. Employment-based green cards also experience high level of fraud and I think it is OK if they are verified, like e.g. you applied for advanced degree GC but your later carrier shows completely different path and you are a chef, or you had a green card sponsored by an employer and you quit right after getting your permanent residence status, not to mention that you might be a public charge. With marriage-based GC, if you are still married to the same person and, even better, you have kids together, there is nothing to contest.

But isn't that stuff they should have already verified during the background check? I mean they took 5 months to put me in line, so it's not that they had to rush the process lol.

I would expect that they should have it done before you are invited to the interview and what happened to you now is just a true oversight. Fairly large number of applicants report that they get "Decision cannot be made" and after that they are quickly approved (unless they are CARRP). But I would say you (and me) are still lucky. Out of 243 cases that I checked around me, 11 is still in "fingerprint scheduled", which is 4.5%. I am really curious whether my theory about thorough background checks of EB applicants is true, as EB immigration is only about 10% of the total GC issued.

I dont think that is the case just due to EB GC, of course there may be additional checks involved. My application is marriage based with the same spouse and we have a kid together. In addition to other belongings together. I had a 4 month wait for an update between FP and inline.

We would need to gather more data to make statistically significant conclusions. My theory is only based on the assumption that it would make much more sense to double check EB applicants, as with marriage based applicants the only thing you need to verify is the marriage itself and a clear criminal history. In case of EB you might need to check the employment history, possibly verify salary, maybe check whether the applicant is a recipient of food stamps or similar programs.

 

It is possible that every one of us will get stuck, e.g. they ask for your criminal history from your home country and the response takes a few months to arrive at USCIS.

Congrats! Please let us know how long it will take for them to schedule your Oath Ceremony. I went to interview about 5 weeks ago and still nothing yet..

One step at a time, they checked "decision cannot yet be made" so let's see how long that will take before I start thinking about the oath. Not having much luck with this process.
