No Tax Return

My fiance (petitionary) didn't work the previous year (2016) because she was a full time student, so she doens't apply for filling the current tax return (W-2) but she has been working since january of this year (2017) and her annual income is more than enough, but won't file a W-2 for the previous year. So when it comes the time of the interview will we still be ok, with the other proosf as the pay stubs and employment letter...?

It shouldn't be a problem. Just bring proof that she was a student. Also bring a couple of previous pay stubs and a letter of employment for this year.

If you did not file taxes for the current tax year for whatever reason the USCIS suggests that you apply for proof of non filing with form 4506.Then I would submit the proof of student status as well. In some cases it may be available to you online if you have a previous filing history otherwise you can fax them the form and send they will respond within two weeks.

Be prepared to need a sponsor as the current tax year is 2016 so even though your current income may qualify, that is not how they determine whether or not you meet the federal income guideline requirement as it is based on your current year's taxes.
