My fiance sent out the package on 11/16/16 without telling me; Admittedly neither of us is expert on the process but I did the best I can to research on how to package the papers and what's included. I gave him the list and apparently he did it his way, so there were missing docs. 

 

Neither of us proposed when he visited me and on the package he only include 1 letter of intent ( nothing from my end), and the BIO form with my information on it; he signed it instead of me. 

Do we have a huge problem?

Huge problem? Not at all. The packet may get rejected, an RFIE (request for initial evidence)., or an RFE (request for evidence).

 

If rejected, it will be returned so he can fix it and re-send.

 

If it's an RFIE or RFE, you will get a NOA1. Then you just have to wait until you get the RFIE/RFE notice and then respond to it promptly. Use the Receipt Number from the NOA1 to track the case via the USCIS Case Tracker website, or via iOS/Android apps. It may come in days, weeks, or months (I-129Fs are currently taking 70-90+ days to process).

 

Edit: The lack of a formal proposal isn't required...only the intent to marry within 90 days. That's what the letters are there to show. That said, if you both agreed to marry already, then there was a proposal...that doesn't just happen out of nowhere. haha

True! We've been dating for 3 years, and we have been talking about getting married, just couldn't leave the country 2 years ago because I was getting an MBA and on my way to getting promoted a head nurse. He's feeling so bad right now that he feels he messed it all up. And he's asking if he can make amend as early as now, and send the missing papers?

Unfortunately, no. For the I-129F, they will not accept additional documentation until they request it. I've tried this personally very recently. It's permitted to add evidence for a CR-1/IR-1 at NVC, but not for the I-129F or during NVC processing with a K-1 (since they just forward it to the embassy).

 

You'll be fine. Worst case, it gets sent back, he fixes it up, then re-sends the packet. Most RFEs only add a couple weeks to the process, too. Just relax, track the case for updates, and you'll be fine.
