I came into US on 10/03/2012 and i have 4 year tax returns if my anniversary date is on  11/04/2017 to make my 5 years, can i still go ahead and file for naturalization with 4 year tax returns. Your response will help me

how did you get your GC

 

by spousal petition or family petition, such as parent or sibling?

 

if by marriage to a USC, you can file based on the 3 year rule, by family, you have to wait until 90 days before your 5th year to file for citizenship

Oh yes but my 90 day i will only have 4 years tax considering the i get my GC on 11/06/2012 do still file with as single

tax season isn't over until April, so probably you will have filed taxes for 2016 by the time you have your interview

 

 

I get my GC through my spouse but we separate now and waiting for final divirce and i got my GC in 11/06/2012 i started work in 2013

you can file for citizenship 90 days before your 5th year, by then you will have filed 2016 taxes, and have 5 years of taxes

 

it will be somewhere in August, 90 days isn't 3 month exactly. you might be divorced by then, so send a copy of your divorce decree as well

Ok thank but i still want know if i can get tax return for 2012 due i have been in US for 2 months

No i did not work i get my 11/6/2012 but my wife file for tax

why would she put you as a dependent when she could save more by filing jointly. not even sure if spouse can be dependent to the other spouse mfs mabye. and if you filed jointly then you did file that year and should be able to get transcripts for that year from the irs.
