USC wants to move back in Manila to study while LPR husband stays in the states?

Hi everyone! My husband and kids moved here in the US last October, my kids and I are USC and my husband is a conditional green cad holder, my kids and I might move back to Manila because I want to study again and my kids will be studying there too. When my husband has the conditions of his green card removed, will it be affected by the fact that i am in Manila? Even if he will be visiting us frequently?

For what you are planning it would likely cause problems during the removal of conditions (ROC) process for him.

 

Think about it for a sec... one of the conditions under his current status is that you two are residing in the US as a bonafide married couple. Take a look at the evidence you have to provide for ROC. Proof of comingling of finances, joint accounts, sharing residence, trips together, etc. Would be difficult to explain a marriage where the two of you are in on different continents.

 

One of the reasons the 2 year conditional green card was developed was to try to prevent arranged fraud marriages where two people would agree to get married on paper for immigration purposes but then go about their separate lives.

 

An option you have is to wait until after the ROC when he receives his 10 year GC. Or, if you can, wait until he becomes a citizen.
