I have two separate questions, hopefully I am not posting in the wrong place.

 

  • My fiancee arrived October 20th 2016, we were married on January 13th, 2017. We are currently still waiting for the marriage certificate to arrive in order to file the I-485 Adjustment of Status form. My question is, seeing as it's already past the 90 day mark, when we finally submit that form (hopefully this week) we should still be ok right? I wasn't sure if the 90 day deadline included the filing of the latter form. 
  • Second question is with regards to name change, she would like to change her name to my last name and we weren't able to do that at the courthouse. Do we file the I-485 form first and go through that whole process with her given name and change it later? Or do we try to do a name change now before filing all of this additional paperwork?

no the 90 day deadline does not include filing for AOS.

the marriage certificate should be sufficient document for name change.  I didn't have to change my name at the courthouse.  I just took on my husband's name after marriage and have used our marriage certificate as proof of that for banks, ID, etc.  File the AOS paperwork with the name she intends on using (Married name).
