Hi all,

I'm a Canadian in the U.S. on an F-1 student visa.

Recently, I noticed that my Canadian passport was due to expire so I got it renewed by mail.

As such, my most recent I-94 has my old passport number on it, and does not reflect my new passport number.

My wife is a U.S. citizen and I am preparing to file for AOS. I'm worried that sending in my I-94 with my old passport number will cause problems with my application.

I have spoken to both USCIS and CBP and have received mixed answers. USCIS said they had no information that this would or would not cause a problem, and advised me to make an info pass appointment (but no appointments are currently available at my local office).

CBP said I would need to leave the country to get a new I-94, but that would violate the dual-intent restriction on F-1 visas.

Anyone have experience with this? If I can't get a straight answer I think I will send copies of both my old and new passports in my AOS application along with an explanation. Will that be enough?

Many thanks!

You absolutely have to submit all passports' copies!!!

I changed my passports as well, and I submitted photocopies of everything. It won't be that much trouble, it's always better to be overprepared!

Welcome to the forum.

Send in copies of the bio page of both passports, along with an explanation. If you are scheduled for an interview, take both passports and explain the situation to the IO at the interview.

Surprisingly this is a common situation, I believe a very similar question was asked last week in this forum by a fellow Canadian.

Good luck on your immigration journey.
