Ok folks i am just making sure i am understanding this correctly. I am American Citizen and Sponsor. I am not using my IRA for assets because i will be making still under 25K for Poverty guidelines (I have a son too) . I also let my lawyer go due to financial reasons, and they did a few things i was not too happy about.

so here is my main focus:

#1. I need a joint sponsor, so i asked my brother who is single to do it. Does he fill his own I-864 (but as joint sponsor) and scan them back to me or mail them back to me?

#2. I have almost everything of a copy in Spanish and English for my marriage certificate, and my Costa Rican wife's birth certificates. Do i just print them off to send for my wife (beneficiary) IV package? I have copies of everything but police certificate because waiting for my brother on the joint sponsor I-864. Costa Rica has expiration of 3 months on Police Certificate.

#3 if i send in the IV package i will send in my AOS as well in one big envelope correct.

What i have now is for STEP 4 (collect financial docs):

A: I have tax transcripts from 2013, 2014 and copy of my 2015 tax return due to i cannot file until my wife has a SSN.

B: I started a new job 2 weeks ago but i am paid weekly and my boss will give me as many copies of my weekly pay stubs for this as i need. the stubs do have company name, address.

*** Do i need my boss to sign it, if so does it have to be notorized?

C: i have access to my certified birth certificate, my wife's as well, but how do i go about A signed, written statement describing the relationship?

D: Proof of assest? Should i bother since i have to have a joint sponsor?

For STEP 5

Like i said before i have many copies, plus from what the lawyer i used to have sent me as well from case file.

Do I send in both packages (IV and AOS)?

Any help would be great. Thank you.

Yes, if you want your brother to be a joint sponsor then he needs to fill out the I-864. Are you not eligible for electronic processing? If that is the NOT the case (i.e., you must mail your AOS documents), then your brother needs to mail an original signed copy to you before you mail out the AOS packet. For postal processing, original, signed copies of all forms must be provided. As always, save a copy of all forms before you mail them out.

Yes, copies of your marriage certificate, your wife's birth certificate, and police certificate are all acceptable.

I would recommend that you put each package in a separate manilla envelope and label them "AOS Package" and "IV Package". Then put both packages into one shipping envelope.

You absolutely can file for taxes, even when you're wife doesn't have a SSN. See form W-7 from the IRS; basically the IRS will assign your wife an Individual Taxpayer Identification Number (ITIN). This will allow you to file taxes jointly. You must do this! By law, if you're married you can no longer file as Single. Moreover, it is excellent proof of a bonafide marriage.

Your boss doesn't need to sign you're pay stubs, but it would be good to get a letter from him stating that you were hired on such and such date and you're current yearly salary is $XX. Make sure it's on an official letterhead and have him sign it. Neither a copy of this letter nor copies of your pay stubs need to be notarized.

I've never heard of a signed written statement describing the relationship being required at the NVC. Where did you read this?

D: Proof of assest? Should i bother since i have to have a joint sponsor?

You can if you like, but be aware for assets, you will require FIVE-times the difference between your current salary and 125% above the poverty line. This could be quite a high number. If you're savings is not substantial and you're brother's salary plus yours exceeds 125% of the poverty line, I'd recommend skipping this.

1) yes your brother signs a completed I-864 and will need to mail it to you along with proof of his citizenship and ongoing income and at least 2015 taxes (preferably 2015 tax return transcript.)

2) yes just a copy of each of these is needed for the NVC. Originals go to interview.

3) Yes

A) you need to file those taxes. You can file right now as married filing separately. Write NRA in the SSN spot for your wife and mail a paper copy of the taxes. Even an extension is due now. You can amend them later to MFJ if you choose. File your taxes asap!!

B) no your paystubs do not need to be notarized. A letter from your employer may be handy because you just started this job, however since you have a joint sponsor it's or necessary.

C) not really required and is embassy specific. You can write a letter descriving the progression of your relationship from beginning to end if you choose.

D)no do not bother

Thanks everyone,

Well when i did file my taxes i sent in the W7 form to IRS in Austin Texas. The IRS showed nothing about it. That was August of this year. All i got was a run around from IRS. Not a straight answer from anyone. So if i filed MFS i pay in, if i file MFJ refund. So i guess i am pretty screwed there. My tax lady helped me out with W7, but like i said no one at IRS could give me a straight answer.
