Hi!

I'm a 24 year old male from the UK and my fiance is a 23 year old female from the US. I've done some searching on Google but can't exactly find what I'm looking for. My US-based fiance was working a job that paid just below the $20k required to sponsor me (it would just be me and her, no children or other dependents), but injured herself at work 6 months ago and will be remaining out of work and on workers comp for the foreseeable future. I have no idea how this factors in to the earnings required? Does anybody have any knowledge or past experience with this?

Also, can I please get some clarification on the joint-sponsor approach? I know that one can be used, but is/can the salary of the joint-sponsor be combined with my fiance's salary, or do they both have to be individual? Example, and not accurate numbers - my finance makes $9000 on workers comp, and her brother makes $17,000 salary, combined that would take us over the minimum required, but separately it would not.

Please help!

Poverty Guidelines for 2016:

https://aspe.hhs.gov/poverty-guidelines

Your petitioner should have 125% above poverty line otherwise a co-sponsor is required. The co-sponsor should reach 125% above poverty line alone.

"A joint sponsor is someone who is willing to accept legal responsibility for supporting your family member with you. A joint sponsor must meet all the same requirements as you, except the joint sponsor does not need to be related to the immigrant. The joint sponsor (or the joint sponsor and his or her household) must reach the 125% income requirement alone. You cannot combine your income with that of a joint sponsor to meet the income requirement."

London accepts 100% with the I-134 for a K-1 visa. You(or joint sponsor) will need to meet the 125% later for AOS and the I-864.

Much easier to use this supplement for the I-864 from the USCIS to determine how much income you need. It lays out 100 and 125% amounts> https://www.uscis.gov/sites/default/files/files/form/i-864p.pdf

You do not combine incomes. The co-sponsor provides an I-134 and must meet the income requirement on their own for their household size plus the foreign fiance(e). Not sure what your situation is, but London also allows for self-sponsorship.
