My husband lost his w2 forms for the most recent tax year.. Here are my questions..

1) Can we just submit the Income Tax Return for 2015 alone without the W2's?

2) Is IRS TAX TRANSCRIPT different from INCOME TAX RETURN?

3) If we cant be able to provide W2's, can we get the IRS TAX TRANSCRIPT online for free? And just submit it instead to NVC even without the income tax return and w2's?

IRS tax transcripts is best way to go. Go to local IRS office or online and get it. It's free and fast or local office is free and fast as well.

Also keep tax return copy too and send them both.

Also you can get your W2 copy from employee or CPA they always have records for up to 3 yr

And my husbands 2014 and 2013 is below poverty guidelines but his 2015 is higher than poverty guidelines. Since they told me that 2015 will be the basis, we will no longer submit 2014 & 2013 income tax return since it is stated that it is optional to submit it. Is that okay?

Because embassy in Mumbai is really picky on that stuff I am not sure about your embassy.

Send your 2015 tax return copy as well as transcript and other 2 yr if you like to. If you have time contact Employee and get W2 copy more you send is better then REF

You have to send 3years tax. Orelse you can get a checklist of carrying that yo the interview or NVC can ask you to send them again. It doesn't matter if he had less income then they want to see if they filed taxes. All the best

Yes thanks! But our problem is what if we won't be able to secure W2 forms for the current year? Can we just send the IRS TRANSCRIPT instead? together with the tax return but without the W2 forms..

We sent W2 of my husband and we had his father as household. I think somehow yiu can retrieve W2. I can give you a link and people can help you there if you are already in the NVC stage. Try to read the very first page of the forum though

We reeived RFE about I 864 also for evidence for income. USCIS requires the income meet the guidleines from line 22 of the federal taxx return. Line 22 is taxable income. If you do not meet the requirement for your household according to number of people in household then you have options of, assets 3X the income requirement for spouses, co-sponsor meeting the requirments including thier household number of people added to yours, real estate, bank letters, employer letters, bank statements for 12 months.

After we sent in the ref evidence they started our case work again, now we have an interview scheduled which requires basically all proof we have used since finig I 129F. The interview will provide either approval for AOS, or more evidence or denial of our case.

We suggest supplying all evidence you have in order to void additonal delays or denials. Keep all records forever.
