Hi there! Hope you could help me here. We already sent our AOS and IV PACKET TO NVC and just got a scan date. My husband sent me the copies he had sent NVC, I just received it now. While checking his Federal income tax return and w2s, and the I-864EZ that wwas filled up I noticed something wrong. I just saw that the amount he entered for the total income for his 3 year tax returnS in I-864EZ is different from what is written in his fed tax return total income, he used the gross pay in his w2 line 1 in the I-864EZ instead of the total income in the fed tax return. To top it off, for the recent fed tax return 1040A was used, and the last 2 years 1040 form was used, was it correct for us to use the I-864EZ form? Will this give us a checklist? I really feel bad right now.

Hi,

To use the I-864EZ, he can only report his W-2 income.

To use his entire income, he would use the I-864.

Best of luck.

I don't get it. The only income he has is from his W2. He used gross pay line 1 in his W2 as the total income for the past 3 years in the I-864EZ form when he should have written the total income that was written in his federal income tax return. I hope my husband did not screw our chances of avoiding checklist.

Thanks.

I got a checklist for making that same mistake in 2013. I put the wrong income on the I-864EZ (I had used 1040EZ and I put total income instead of adjusted gross income). I'd say get a new I-864EZ ready to go right now with the corrections, that way you guys will be able to answer the checklist quickly.

How do we do that? Do we send a new filled up form? Even if NVC has not yet sent or informed us about a checklist?

No, you wouldn't send it to them until you receive the checklist. I'm just saying to make the corrections to the form now so you'll have it ready for when the time comes to respond to the checklist.
