I-212 Questions (deported after filing I-130 last month)

I think I finally get the deal with the 601 waivers, which we need to prepare. However, I am at a loss with understanding the process for the 212 and how it relates to an already filed 130. Does it replace the 130? When does the 212 get filed? Now? Do we file here in the US where I am or consulate? At the interview? With the 601?

My hubby was deported and now we go on to the Consular Processing in Paris. The 130 was just filed 2/1/07. Received NOA1 only. Also filed 485 but now that is null since the deportation.

Any thoughts please on the 212 procedures. Thx!!

The 212 waiver is for deportation. You must file it in addition to your petition, whether that's I-130, I-129F, etc. I think that when people need the I-212 waiver AND the I-601 waiver, they usually file them together. So, once you go to the interview in Paris (after the I-130 is approved) they will deny the visa because of deportation (and other 601-related problems?) at which point they'll tell you whether or not you're eligible for those waivers.
