Hello,

This is my first post on this site, so I apologize if it's in the wrong category; I couldn't find anyone else that seemed to have a similar issue.

I recently filed I-129F (April 21, 2016) for my fiancé in India. From other timelines that I've seen, it seems that his interview will most likely be towards the end of 2016. I am a recent college graduate, and just started a new job making well over the 125% poverty guidelines. However, at the time of the interview and my affidavit of support, I will only have a couple months' worth of pay stubs and a letter from my employer. I do not have any previous tax returns as this is my first full-time job, but I do have over $30,000 in a checking account. I would rather not use a co-sponsor. Has anyone else had a similar experience?

Include a statement that you were not legally required to file taxes because you were a student and your income was too low to need to file. Add on there that you are now a graduate with a position that makes well over the poverty guideline requirement and your fiance(e) will not become a public charge because you make more than enough to sponsor them.

Include the letter from employer and all your recent pay stubs to prove the annual income amount you will list on the I-134.

Thank you! I've been a full-time student for pretty much my entire adult life, but I did briefly take some time off in 2014 for 6 months. During this time, I worked a part-time job in a restaurant and did file taxes, but only for that year -- the income filed was so little (about $4,000), so is this tax return even worth including?

Only need to include your most recent tax return. As for the joint assets, the CO may only count half of that amount as yours, since it is joint. However, your current annual income is the most important factor, and you make more than enough so hopefully the CO is going to understand you are recent grad and just starting your career. The assets won't even matter because your income is enough.
