I am stressed beyond belief, have exhausted my list of options, and don't know what to do now.

Here's my story:

I submitted my I129F package around September or October of last year and it took one month to get approved, then the second step took less than a month. Everything was moving very quickly. My fiancee got his medical exam in December and was booked for an interview in January.

However, prior to his interview, he found that since he had had TB, he needed additional testing, so in January, he went to take the sputum test which is 3 days of coughing up sputum to be tested. Because of the sputum test, his interview was cancelled and the test results would take 2 months.

About 9.5 weeks after taking his sputum test, he went to pick up his test results (non-reactive) and was scheduled for fingerprinting and an interview.

Here is where it gets problematic.

In his interview, the lady told him he was approved, but he would have to leave India in 2 weeks. The visa processing, he was told, takes 7 work days. So that leaves him with less than a week between getting his visa and leaving. And he needs that extra time to travel from Delhi back to his home to pack up and also get an exit permit.

Right now, it has been over 7 work days and he still doesn't have his visa. I just called the embassy in Delhi, and they're apparently closed today (Friday) and Monday (the day he has to leave India). How can they tell him he has to leave in 2 weeks but take more than 2 weeks to process his visa????

So my questions are

1--Has anyone else been given 2 weeks to leave the country?

2--If they don't give him his visa within the two weeks, what's going to happen? This is not his fault. He and I did everything on our part. I don't know why the embassy is holding onto his passport if they told him he has to leave within 2 weeks of his interview??

3--I have called the number given by the embassy, I have called NVC in the US, I have called the embassy in Delhi. No one can help me. I feel so helpless, especially because we did everything so thoroughly on our part.

Please help.

It sounds like the CO was saying the visa would have very little time left on it because of the medical date and TB.

You should contact the consulate to ask about the visa expiration date and if a new medical could be given so the visa could be re-issued with an expiration date that will actually allow him to use it to enter the US.

Thank you, KayDeeCee, for your advice. I still find the whole thing very odd and just incomprehensible.

Right now, his passport is still with the embassy. Would he have to go back to the embassy? Will he have to do his interview again?

This is all very stressful also because we already have a date for the wedding and everything has been paid for and reserved.

Timelines quoted by the embassy are approximations (just like everything else in India). I wouldn't make specific plans until passport+visa in hand; can never foresee last-minute glitches. (Despite verbal approval at interview, my wife did not book her ticket until she had her passport and verified her visa details.)

Are you sure about Monday.. does not show up as a holiday on the embassy calendar.

And what's an exit permit? I recall no such thing in India.

yeah, he hasn't purchased his ticket or anything, but when he was scheduled for his interview back in January, I already started working on booking a venue for July because I figured he'd be here by then.

Anyhow, yes, when I called, the receptionist said they are closed Friday and Monday. Even if it's open Monday and he goes to collect his passport, he'd need to get an exit permit as a refugee Tibetan living in India. So there's no way he can pick up his passport, get an exit permit, and leave India, all on the same day.

So frustrating.

Oh yeah, the bureaucracy known as the delhi embassy can indeed be very frustrating, unfortunately. Well hopefully he can get the visa in hand next week, tie up lose ends, and be on his merry way to the US in time for the July wedding. Good luck!
