Hi guys,

Just wanted some insight into this as I am still confused. We have been approved by the USCIS and through NVC now so we are looking towards the interview. My fiancé is still in college and thus has no real income except from student loans, her mother has agreed to sponsor us, she makes 35k a year and only technically has 1 dependent, my fiancé. However she has only been earning 35k for 2 years, as prior to that she was a stay at home mum. Will this be an issue as we only have 2 years of taxes? Option 2 would be for my fiancées aunt to sponsor us, as she makes well above and has done for years.

$35K is good for a household of 5. What "technicality" are you using for her household count? The household count guidelines are pretty straight forward.

If her current annualized income meets the requirement things ought to be fine.

Hi guys,

She does not have to be over the poverty level for three full years. They want to know her current income is sufficient. London does not even require any tax returns with an I-134. She could be approved with a letter from her employer stating her current yearly salary. It doesn't sound like you need Option 2.

Sorry, I guess I didn't explain that properly. She is the only dependent, yet she is barely a dependent so to say, as she is totally self sufficient and lives most of the year at her college campus.

She does not have to be over the poverty level for three full years. They want to know her current income is sufficient. London does not even require any tax returns with an I-134. She could be approved with a letter from her employer stating her current yearly salary. It doesn't sound like you need Option 2.

Okay perfect! Thanks for the helpful answer! Not sure why I had the idea of needing 3 years in my mind. So would the 2014 and 2015 taxes, a letter from her employer and the I-134 definitely suffice? I don't want to get held up at all if I can help it

As I said before, London would approve you with ONLY an I-134 and an employment letter from Mom and nothing more. You could also be approved with ONLY I-134 and 2015 tax return complete with W2. But you can take as much as you want.

London is not as difficult as you are imagining after reading all the lore in the K1 forum. Each embassy does things a little differently. What is acceptable in London, may not be in Manila for example.

When you adjust status after marriage, there is another Affidavit of Support with stricter requirements. Your wife and her Mom must each do one. The form asks for the income figures from 3 years of tax returns. The most recent tax return must be submitted. They can also supplement their proof with employer letters and 6 months of pay stubs, proof of assets, etc. But there is still no requirement to be over the poverty level for three full years.

Perfect, thank you so much for the information. One final question though as I want to make sure everything is in order before I leave the US back to the UK for the medical and interview etc. whilst I can get fresh copies whilst visiting out here. So, what I have put together is a:

1. Letter from her employer stating a salary of 18,000 dollars per year

2. An official letter from the court stating her income from her divorced husbands pension is 14,000 per year each year

3. Her most recent tax transcript showing a gross income of the year 2015 of 32,000 dollars

4. An I-134

I don't need anything from my fiance at all correct? As she is not financially sponsoring me, only her mother?

Correction, we do not have tax transcripts we have her 1040 and W2 for 2015, will this suffice?

A 2015 tax return with W2 is as acceptable as a transcript. The W2 kinda verifies the income reported on the tax return is not some faked amount.
