Hello! My fiance and I are currently slogging our way through the K1 visa process. Just last month our I-129F packet was approved, and now we're working on the paperwork leading up to the interview.

My question is about the affidavit of support. I'm currently unemployed and therefore have $0 income and obviously won't qualify by myself. Thankfully, my mom has agreed to help me out, but the only issue is that she currently lives in Belgium for work. I've read up a bit about the eligibility of sponsors living abroad, and am confident she'll qualify, seeing as she still maintains full US citizenship and a permanent residence here, and is working for the international branch of an American owned company. Furthermore, she's still the one paying the bills for the house where my soon-to-be husband and I will be living, makes frequent return trips home to stay with me, and all her income has been reported to the IRS each year she's been working abroad.

Would she be considered a household member, despite working and living abroad, and therefore submit a I-864a along with my I-864? Or would she need to apply as a joint sponsor and file a separate I-864 along with mine?

Any joint sponsor completes their own I-134. You also complete an I-134 regardless of income as you are the primary sponsor.

The I-864 come into play later for adjustment of status.

Do some reading in the VJ guides to familiarize yourself with the process and forms needed at each step.

Any joint sponsor completes their own I-864. You also complete an I-864 regardless of income as you are the primary sponsor.

Thank you for the quick response! But, would my mom need to apply as a joint sponsor in the first place? Or could I list her as a member of the household and lump her income in with my I-864, given the circumstances that I described above?

EDIT: Just saw your edited reply, oops! It looks like we both misread the checklist we were given! I'll go do some more reading, thanks!

Hi, really really sorry to double post like this, but I've been reading up more on the process and I have some questions about the I-134 form, again for the purposes of my mom filling it out. I haven't managed to find anyone else in my exact situation, which makes finding an exact answer tricky.

Again, my mom maintains citizenship and a domicile in the US, but is currently living in Belgium for work (again, for the international branch of an American owned company.) Her income is foreign earned, but she has been reporting it on her federal tax returns, and the liquid assets of our home (which she is the legal owner of) alone should be more than enough to push us past the poverty line. There is also ample evidence of her US bank account being wired money each month to pay the home's bills.

Despite all that, will the fact that her income is foreign earned keep it from being valid for consideration for being a co-sponsor? When she fills out the form, would she put her US residency's address under section 1, or her current address in Belgium? And when it asks 'how long have you been residing in the US' in section 2, what would she have to put for that? That would just be her date of birth, right? Will the fact that she's currently living abroad create any sort of conflict with that?

So sorry to keep asking so many questions, but this whole process is just so overwhelming, and my circumstances are more than a little atypical as I've come to find out. :crying:

What country is the alien coming from? Not all embassies/consulates are the same.

My Fiance is coming through the London embassy, as he lives in the UK.
