Hi everyone,

This is my first post here.

I am a US citizen that wishes to marry my girlfriend from Europe, who I met in the US while she was on a summer exchange program in 2015. I want to sponsor her for a green card and am aware of the two options, i.e. K-1 and CR-1 visas. I have also visited her country recently and we regularly keep in touch.

My concern is with presenting my affidavit of support. I am asked to present my most recent tax return. For the year 2015, I have exceeded 100% of the HHS Poverty guideline, but not at the 125% level. This is due to me being in a masters program and having only worked for half the year.

In addition, after returning to the US from visiting my girlfriend, I have received a full-time job offer at a corporation where my income will exceed the 125% Poverty guideline. if I am correct, I can fill this in under current income.

I would like to know, if in my situation, it is viable to sponsor my girlfriend at this time.

Thanks for your time

For the K1 process you would need 100% of poverty guidleline. Once you're married and need do the Adjustment of Status process then you would need 125% of the poverty guideline.

Yes, you can sponsor your fiancée (or get married and sponsor your wife). Either way, the affidavit of support asks for your CURRENT income, not the income you made on your 2015 taxes. You can prove your current income with an employment letter and/or paystubs.
