Hi,

My partner & I were married approx 1 years ago and went through the immigration process. My wife is a US Citizen & I am from Ireland. We have known each other for years and decided to get married as I said about 1 years ago. After this time, and due to the fact that my wife was unable to have children, her insecurities surrounding that, and my indecisiveness about wanting children we decided that it would be best that we parted ways and we both agreed that a divorce was appropriate. We have remained the best of friends throughout and continue that way to this day.

I have moved back to Ireland temporarily and in the last few months have realised how having children is not that important to me and that being with my wife is more important. She is of the same opinion and we have decided to be with each other again. I am to return to the USA in 2 months after a 4 month absence from there.

I am due to file for the removal of conditions at the end of this year. The questions I have are;

1. We have spoken about re-marrying. If we were to do this can we file the petition jointly to remove conditions under the current application as normal in effect, as if we had never been divorced?

2. Can we file the application jointly if we don't get re-married before the end of the year ?

3. Is it better to file the I-751 on my own?

I would appreciate anybodies input into this scenario or if someone had something similar happen to them. We are tired of the red tape that has to surround normal life instances. Everyone makes mistakes but to have the thought of being told you cannot be with someone due to immigration bureaucracy is just wearing on us.

We both want to continue to build a life together and know we jumped the gun getting divorced.
