Hey everyone, this probably isn't the right place to ask, but since my fiancee came here on a K-1 visa, maybe some people can help me out. I just had a couple of questions about getting a non-driver's license, specifically in NY. In order to obtain this non-driver's ID, a person has to accumulate 6 points of identity. Three points are given for a foreign passport with a I-94 form, but the I-94 form must be valid for at least 6 months. Since my fiancee came on a K-1 visa, its only valid for 3 months. So my question is, would the passport be accepted at least as proof of date of birth? And also, a U.S. Employment Authorization card is worth three points too, but for some reason, it states the U.S. Employment Authorization card must either be INS 1-688B or I-766. However, the EAD card I see on here and in the USCIS webpage is I-765. Is the I-766 perhaps a typo or is that another type of Employment Authorization card? Thanks

Hi Lou_7979,

Good luck on your immigration journey. I don't know about getting a non-driver's ID license in NYS, as I got my Canadian license exchanged for a full NYS driver's license here. The best is to call the NYS DMV in your area regarding your particular situation.

Regardless of the situation, what's needed for a NYS driver's license though is a valid SS#.

Besides, if you're not in a hurry, it might be easier for your fiancee to get a license after you are married and get the Green Card, as your fiancee doesn't have to worry about changing the license from her maiden last name to her married last name on the license if applying after she is married (unless of course she wants to keep her maiden last name).

OK we applied a few months back and were able to get it for my wife. Here is what you need.

passport with valid visa and I-94.

Marriage certificate to prove you got married in 90 days.

Social security card.

Bank card or Credit card.

Proof of residence like an offical letter from any office.

We had no problem other then that the application was approved by a supervisor and also we went to the office on 6th ave. Make sure you take all of these papers and you will get a 1 year non driving ID.

As necessary as having an ID is, I doubt changing the name is really a big deal. While NY makes it a little more complicated with not giving you the new ID *right away* like some states do, all it takes is going to the DMV and maybe paying a small fee. Not really a huge deal.

Here is the NY states list of forms of ID and there point values. I think you need 4 points for the non-drivers id and a ss card. (or 6 points to be exact).

Irfan, on the NY state DMV website, it said the I-94 had to be valid for at least 6 months. But since my fiancee came with a K-1 visa, its only valid for 3 months. Was this a problem when you went to get your wife's ID? And when you mentioned "Proof of residence like an offical letter from any office," what office are you referring to? I live in an apartment with my fiancee, so do you mean I need a letter of proof that I live there. Thanks
