Hi, guys, need your help to clarify Affidavit of Support.

my wife and and are applying i-130 and i-485. I'm on H1b here in US with I-94 till 2017. We got married in 2015 and live together since march 2015.

She is a student and is making less then 19k a year in 2015. Their for her pure income is less then poverty limit. But we leave together and her income does not really make much in our house income.

How should we file i-864? Can she claim my income as household? Or do we need to file I-864a as well? Should we wait to file joint taxes in 2015?

Please help, really confused here

Your income (the intending immigrant's income) can be counted in her household income if it's legal (which it is). You don't need to file I-864A since you are the intending immigrant.

@newacct Thank you. Is there any requirement what proof of income should we provide alone with tax transcripts for 2014-2013? For 2015 do we need to provide W-2 or joint tax declaration?
