I married my wife 5 years before I even dreamed of becoming a US citizen, (1 year ago). We lived together for 4 years, then we separated (Not legally, still married) We decided to get back together and give it another shot. I am filing I -130 through consular process. I would like your advice on the following:

1) Married wife 5 years before becoming a US citizen. Can they still question if marriage was bona fide?

2) We lived together for 4 years before separation (not legal, still married) but have lived in different countries for 4 years. Kept in contact.

Would greatly appreciate any advice on this situation.

You will want to give evidence of having in a bona fide marriage, not just evidence of a wedding ceremony from years past. Expect the consular officer to ask a lot of questions about the living in separate countries after cohabitating for several years.

They may question why the sudden change of plan now that you are a USC. Where were you living together before? Why not go back there instead of the upheaval and paperwork you are about to put yourself through? It may look, to the consular officer, that you have reunited for the purpose of getting your wife into the USA. Your job is to prove that this is not the case.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
