Filing AOS with EAD

Okay I am a little confused after reading the instructions and the guides.

My husband came here on a K-1 (did not get the temporary EAD). We are filing the I-485 with the I-765. According to the instructions he should file under category C 9 (adjusting status). This is why I am confused: As evidence for C9 it says he should show evidence of filing to adjust status, but we do nto have that since we are sending in the aos papers in the same package as the EAD papers.

Are we correct in sending in the papers as a C9 classification? What evidence should be attached to this application. We have the 1-94 (front and back) , copiy of the passport bio pages, and copy of the K1 visa and entry stamp at POE.

24 March 2009 I-751 received by USCIS

27 March 2009 Check Cashed

30 March 2009 NOA received

8 April 2009 Biometric notice arrived by mail

24 April 2009 Biometrics scheduled

26 April 2009 Touched

...once again waiting

1 September 2009 (just over 5 months) Approved and card production ordered.

You are right in the C9 classification...

Evidence is

the I-94 front and back...copy marriage certificate ...copy of NOA2 .... copy of vaccination sheet..copy of applicants birth cerficate...copies of divorce papers from both (if this applies)

cheques for applications we did two seperate ones for AOS and EAD..

REMOVING CONDITIONS

11th Aug 2008 - Mailed I-751 to CSC.

12th Aug 2008 - Application received

14th Aug 2008 - Cheque cashed

18th Aug 2008 - Received NOA-dated the 12th

26th Aug 2008 - Received Biometrics letter

4th Sept 2008 - Biometrics-Detroit-Complete-'Touched'

5th Sept 2008 - 'Touched'

1st Dec 2008 - APPROVED-Card production ordered -112 days

8th Dec 2008 - USCIS mailed approval notice.

8th Dec 2008 - Received my 10 year Greencard in the mail. took 2 days.

Although I have the above date for approval my card actualy states the

2nd December..

You would think, but this is USCIS we are talking about and I just needed the reassurance LOL
